ProtectMarriage.com, the umbrella group behind a ballot initiative that would overturn the California Supreme Court decision that legalized gay marriage, sent a certified letter this week asking companies to withdraw their support of Equality California, a nonprofit organization that is helping lead the campaign against Proposition 8.

"Make a donation of a like amount to ProtectMarriage.com which will help us correct this error," reads the letter. "Were you to elect not to donate comparably, it would be a clear indication that you are in opposition to traditional marriage. ... The names of any companies and organizations that choose not to donate in like manner to ProtectMarriage.com but have given to Equality California will be published."

The letter was signed by four members of the group's executive committee: campaign chairman Ron Prentice; Edward Dolejsi, executive director of the California Catholic Conference; Mark Jansson, a member of The Church of Jesus Christ of Latter-day Saints; and Andrew Pugno, the lawyer for ProtectMarriage.com. A donation form was attached. The letter did not say where the names would be published.

The unusual appeal reflects the increasing tension surrounding the tight race over Proposition 8, which would change the California Constitution to limit marriage to a man and a woman. In recent days, both sides in the debate have accused their opponents of threatening their respective campaign volunteers and misleading voters.

San Diego businessman Jim Abbott, who owns a real estate company and is a member of Equality California's board of directors, received one of the letters late Wednesday afternoon. His adult son called Abbott to read it to him.

"He characterized it as a bit 'Mafioso,'" Abbott said. "It was a little distressing, but it's consistent with how the 'yes' side of this campaign has been run, which is a bit over the top."

I often talk of the conservative movement as being structured like an organized crime syndicate.  That's because it is.

and can afford to, should make another contribution, of the same or greater amount, to the No on 8 orgs/campaign.  They should reply to the letter with a photocopy of the new check and a request that they do get "OUTED" as supporting the cause.  Make them understand that intolerance is to be reviled, not tolerance.  Stand up and be proud.

First, I'm not a lawyer but I'm almost certain this is criminal activity.  Notify the Public Inquiry Unit of California Attorney General Jerry Brown at (916) 322-3360, toll free at (800) 952-5225, or fax at (916) 323-5241.   Also, contact California Secretary of State Debra Bowen at (916) 653-6814.  That is the General Information number for the California Secretary of State.  The Elections Division numbers are (916) 657-2166 (Main), (800) 833-8683 (TDD only), and (800) 345-8683 (Voter Fraud Hotline).  Is blackmail a state crime, or federal, or both?  Since letters were sent through the U. S. Mail, that should get the federal government involved.  If blackmail is a state crime (too), I would like to see California Attorney General Jerry Brown lead the prosecution.

Second, any business that caves into these SOBs needs to be boycotted.  

Third, any business that supports the No On 8 campaign AND does not give in deserves our full-time support.

This is absolutely rotten, and it looks as though California Attorney General has just been handed a dream case to prosecute.  Serious prison time is in order.

Blackmail or extortion usually involve a threat to reveal embarrassing secrets to the public in exchange for money.  Correct me if I'm wrong, but there's nothing secret about the fact that these businesses contributed to No on 8, so there's nothing to "reveal" to the public.  So it's underhanded and assholish, but probably not criminal.
Any prosecutors out there who can weigh in?

But they are making threats and will only stop IN EXCHANGE FOR MONEY.  This looks like a shakedown.  And they are using the U. S. Mail to deliver their threats.  This is completely different from a boycott.  Boycotters operate in public, encourage others to vote with their dollars, and seek a change in policy.  But as I said, I'm not a lawyer.

Also, I wonder if the actions of Prop 8 supporters could cause it to be invalidated based on election fraud, blackmail, or something like that (if it indeed passes).

What other laws may apply here?

On the other hand, we could take the publicly available information on which businesses oppose Prop 8, publicize it ourselves, thank them, and support them.

It's not blackmail, but it might meet the definition of extortion, since they're actually demanding money for their own campaign rather than simply demanding that the companies publicly disavow the other side and stop giving them money.

there was a post by someone who'd gotten a threatening letter like this. He (the recipient) was threatened with having his name published on a list of donor to liberal causes, or something like that.

Unfortunately, I can't remember the name of the author, and I've had no luck trying to find it again. Anyway, what I got out of it was that it is illegal to publish names of private citizens like that, in that way (can't remember all the legal details). I don't know if the rules are the same as applied to businesses.

Who is going to be swayed by this?  We're going to say you supported gay marriage if you don't give us money?  Who cares?  Who's going to pay attention to that except for people in the Mormon community, who probably aren't supporting these companies anyway.

In San Diego, the big money folks supporting Prop 8 and the size/power of some of these mega-churches can have a legitimate impact on small businesses in particular.

I have the dual honor of living in San Diego and working for the Courage Campaign.

We launched a petition calling on the Mormon Church to stop lying earlier today for those interested.

And separately, I'll add that San Diego is ground zero on this fight in a number of ways. There aren't too many in-state sources of big money relative to the Mormons, but a lot of them are the cream of the San Diego moneyed elite. And there'll be a huge Yes on 8 prayer rally at Qualcomm Stadium here on November 1. I'll be there so you don't have to, but the counter-events throughout the state should be awesome.
