Court Says Colorado's Katherine Harris Is Violating Federal Law With Voter Purges

Remember last week when I warned that 2008's version of Katherine Harris - Colorado Secretary of State Mike Coffman - was using his power to try to throw the election here in this swing state? Four days before the election, he's gone into overdrive. According to a breaking news story just off the wire, he has been violating federal law with his voter purges, which - despite his public assurances to the contrary - have been continuing:

A federal judge today angrily ordered Colorado Secretary of State Mike Coffman to stop purging names on the state's voter registration rolls.

The judge's order came in a telephone hearing this afternoon that was the latest clash between Coffman and a trio of advocacy groups who had sued Coffman over the purging of the voter rolls so close to the election.

Wednesday night, the two sides reached a settlement designed to ensure voters whose registrations were cancelled within the 90 days before the election wouldn't be disenfranchised on Election Day.

But state officials acknowledged today that 146 more names had been purged since the settlement was reached.

Coffman has said previously that he has followed the law and is allowed to cancel voter registrations this close to the election for a variety of reasons. Attorney General John Suthers, who, like Coffman, is a Republican, has said Coffman was legally allowed to cancel 2,454 duplicate voter registrations close to the election.

This is serious stuff, and because it is in one of the most closely contested states in the country, it has very clear national implications. Contact the Colorado Secretary of State's office immediately to lodge your protest, and then call Governor Bill Ritter's office to demand he use his power to stop the state government he runs from disenfranchising voters:

Here's the key language from the article:

"U.S. District Judge John Kane said that was a violation of federal law. Kane warned that if Coffman doesn't stop the practice, 'he'll be listening to me personally.'"

Before I even read the article I thought to myself "Coffman better not screw around with Judge Kane!" Any lawyer who has appeared in his courtroom can tell you DO NOT MESS with Judge Kane under any circumstances. He runs a very tight ship and is a tough judge. You have to be really prepared when you appear before him, because he doesn't tolerate fools gladly.

And while he's not going out of his way to cause controversy, he's not at all afraid of it either. He's given Coffman as much rope as he intends to, and Coffman better make personally sure that no more voters are purged, or he'll be in contempt of court.


In a statement, Coffman said he believed the judge's original order did not require him to stop the purges but rather said the settlement left the "processes leading up to Election Day" unchanged.

"My office and the county clerks were in full compliance with the judge's original order," Coffman said. "As required after today's court order by Judge Kane, I'm instructing the county clerks to reinstate the registrations cancelled since 9 p.m. Wednesday evening."

That is what is what they call a cover-your-ass provision. "I thought I was in compliance." He's blatantly lying, which won't make Kane any happier. When they next appear in court he's likely to get a tongue lashing if no worse.

You can tell Coffman realizes he's skated right up to the line on this one and that there's no more give.

When Kane threatens to hold Coffman in contempt, he's not kidding. Coffman is facing the prospect of spending election day under federal arrest. That might be a badge of honor in the 6th congressional district where they're a bunch of Tancredo loving idiots. But, it won't do wonders for Coffman's career in the House to begin his tenure in office from behind bars!

Bottom line, Coffman tried to roll the judge and Plaintiffs, and got stuffed on this one.
