New Brief Discusses Improvements for Counting Provisional Ballots

Although the Help America Vote Act of 2002 provided "fail-safe" provisional voting to prevent the unnecessary disenfranchisement of eligible citizens who show up at the polls to find that they are not on the rolls, there are still thousands of voters whose ballots are not being counted.

For most states this year, the economic crisis has taken precedent over other serious policy issues, including election reform. In fact, the few key states that are dedicating this year's session to election reform instead of major budget issues are stirring up voters as they put their rights on the line. Like the highly publicized battles to pass voter ID in Texas and proof-of-citizenship registration requirements in Georgia, Florida's notorious 80-plus page omnibus election bill takes the cake in breaking the spirit of democracy.

After the voters spoke last November by turning out in record numbers, we enter a new year with a new president and multiple new agendas for election administration in the states that bring both excitement and concern from voting rights advocates. Whether the discussion is about  upholding the landmark Voting Rights Act, the disenfranchisement that comes with voter ID, or even the distribution of provisional ballots, the conclusion remains the same: we should work to protect and facilitate every eligible citizens' right to vote, not impede it.
